The Year of the Railways will encourage rail as a sustainable, innovative and safe mode of transport, capable of providing essential services, even in the event of an unforeseen crisis. This is reflected in the strategic role played by the railways in maintaining important links during the COVID 19 pandemic for the transport of people and goods. On November 20, the presidents of the SMART Transportation Division (SMART-TD) worked on railways represented by the National Carrier Conference Committee (NCCC), the changes proposed by smart-TD to agreements on wages, normal conditions and working conditions. A consolidated (or compliant) agreement is a document containing all approved amendments to the existing approved agreement. The railways` attempt to evade their legal obligation to negotiate on these issues of great importance to our members has left us no choice but to impose these rights in court. If the airlines` proposals are implemented without a successfully negotiated application, they could be extremely detrimental to our members and their families. What is even more scandalous is that the process they are trying to impose would allow railways to reduce workers` access to drugs and doctors in the midst of a pandemic. If they were to reward the contributions of their principal employees with risk charges, railways would instead seek to reduce medical benefits when they are most needed. Events like this are the reason why, more than a century ago, railway managers were called “predator barons”; their actions today are proof that the label is still valid. Unfortunately for working-class Americans, this is the way of many businesses across the country in Donald Trump`s America; Essential employees are treated as redundant employees. We will not stand idly by in the face of the way management is attacking the fundamental legal rights enjoyed by our members.
While the national rail contract between SMART-TD and the ncCC-represented railways will be amended on January 1, 2020, the existing contract will remain in effect until it is amended and ratified by smart TD members in accordance with the craft autonomy provisions of The Twenty-One B (21B) section of the SMART Constitution. CLEVELAND, Ohio and WASHINGTON, D.C., (November 1, 2019) – Leaders of 10 railroad unions announced today that their organizations will participate in coordinated negotiations in the round of national negotiations that began on November 1, 2019. The unions composed of the coordinated collective coalition are: the Railway Labour Act protects the agreements of an amendment, except by the procedures provided for in Section 6 of the Act. The airlines agreed on the crew members years ago. Not only that, but to end the ongoing struggle for the crew, the airlines also agreed to moratorium regulations that excluded each section 6 of a crew communication until the last protected employee voluntarily left the service.
