Buyer Exclusivity Agreement

Long speech, little sense, if you intend to give your agent a full commission in the next few months, I don`t think you should sign an exclusivity contract and assure them that they will receive at least one commission in the near future. If you`re only buying one property in the near future and there`s no chance the agent won`t get away with it, I`d promise them at least a small amount for the deal, or more if it`s an MLS deal. Exclusivity or option agreements and exclusive deposits are not for every transaction, but there will always be a part of the market and a type of customer for which they will have their place. It seems to us that, as I said, everything is negotiable in real estate. Sure, an agent might want a four-month deal, but you could do 12 hours if you really wanted to. If you`re not sure if this agent is right for you or if you don`t engage in your home buying search, you may want to consider a reduced term. At the same time, I would be reluctant to sign a months-long agreement with an agent before I have a chance to see how they were, to work with them. A lot of buyers end up like this with agents. The buyer agrees to collaborate only with the broker and agent you have chosen. The expectation is that during the contract period, you do not ask another broker to establish a relationship with you to help you buy a home.

With the signature, you agree to pay a commission to this broker if you buy a house during the term of the contract. If you have signed agreements with several agents, you owe each of them an agreed commission, even if only one of them really helped you. No one wants to do that. At the end of the set period, if the buyer cannot exchange contracts, the contract ends and the seller is free to negotiate with other buyers. Normally, the buyer is required to pay a non-refundable deposit to cover the seller`s costs if the buyer does not continue. On the one hand – speaking as an agent – I am not crazy about buyers` agency contracts, because they often encourage buyers to work exclusively – and for a long time – with someone they know little about, who sometimes does not turn out to be as competent as they have the right to expect from them. I`ve seen this many times. This is a pre-agreement between the buyer and seller at the beginning of a transaction on the sale and purchase of real estate.
